Faya Terms of Service

1. Acceptance of Terms

By accessing or using the Faya application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. We reserve the right to modify these Terms at any time, and continued use constitutes acceptance of the updated Terms.

2. Eligibility

• You must be at least 18 years old to use the App.
• If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to your use of the App.

3. Account Registration

• You may register using an email address or mobile number.
• You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
• You agree to provide accurate information and update it promptly if changes occur.

4. User-Generated Content

4.1 Ownership

• Content Rights: You retain full ownership of all text, images, and other materials ("Content") you post on the App.
• License Grant: By posting Content, you grant Faya a non-exclusive, royalty-free, worldwide license to:Store, display, and distribute your Content solely for operating and promoting the App.
  • Modify or adapt Content technically (e.g., compression, format adjustment) to optimize user experience.
• Restriction: Faya may not use your Content for commercial advertising or product development without your explicit written consent.

4.2 Prohibited Content

You agree not to post Content that:

1. Violates Laws/Intellectual Property

   Breaches any applicable laws or promotes illegal acts (e.g., fraud, drug use).
   • Infringes trademarks, copyrights, or other rights of third parties.

2. Harms Others

   Contains hate speech, discrimination, or harassment based on race, religion, gender, etc.
   • Includes threats, personal attacks, or doxxing (sharing private information).

3. Inappropriate Material

   Shows explicit sexual content, violence, or self-harm.
   • Promotes dangerous activities (e.g., reckless stunts).

4. Misinformation/Deception

   Spreads false claims about public events (e.g., disasters, health crises).
   • Uses misleading tactics for financial gain (e.g., pyramid schemes).

4.3 Content Moderation

• Review Process: Faya uses automated tools and manual checks to screen all Content. High-risk posts (e.g., adult material, violent content) are blocked immediately.
• Removal Requests: To have your content removed, please email [email protected] with your account details, a link to your post, and your reason. Faya will respond within 1 business day.
• Enforcement Actions: First violation: Content removal + warning.
  • Repeated violations: Temporary or permanent account suspension.
  • ○Urgent threats (e.g., malware, illegal content): Immediate removal without notice.

4.4 User Responsibilities

• Compliance: You must ensure Content is legal and does not violate others’ rights.
• Third-Party Content: If reposting someone else's work, clearly credit the source and obtain permission.
• Minors: Users under 14 must have parental consent to post, and certain features (e.g., location tags) are restricted.

4.5 Disclaimer

• Faya does not guarantee the accuracy or safety of user Content.
• You assume full liability for any disputes arising from your posts.
• Faya reserves the right to update these rules at any time, with notice via in-app announcements.

5. User Responsibilities

You agree to use the App lawfully and respect the rights of other users.

• You may not:
• Reverse-engineer, hack, or disrupt the App’s functionality.
• Impersonate others or use bots to manipulate interactions.
• Collect personal data from other users without consent.

6. Termination

• Faya may suspend or terminate your access to the App at its sole discretion, with or without cause, including for violations of these Terms.
• You may delete your account at any time via the App’s settings.

7. Disclaimers

• The App is provided "as is" without warranties of any kind. Faya does not guarantee uninterrupted, error-free, or secure service.
• Faya is not responsible for User-Generated Content or any damages arising from your use of the App.

8. Limitation of Liability

To the maximum extent permitted by law, Faya and its affiliates shall not be liable for:

• Indirect, incidental, or consequential damages.
• Loss of data, profits, or business opportunities.

9. Governing Law

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles.
